As a former Condor project member (grad student, not staff) I can give you a (limited and unofficial) answer to your question.  Clearly the "ask and we'll consider it" approach is not what most people would consider open, but it is unfortunately necessary given the following facts:

1. The Condor source is not "untidy." It is a leviathan.  In my opinion it does more harm than good to open source that has been developed under a closed source model for many years.  Starting a new project as open source is a good idea.  Open sourcing a small project is a good idea.  Condor is neither new nor small.

2. Given fact #1 Condor probably should remain 100% closed source, but the Condor team would like to serve its community in the best way possible.  The best way possible at the moment is "ask and we'll consider it".  This is not a euphemism for "not a chance".  People have asked, and the team has given out source.

3. Getting the code to the point where the team feels comfortable with open sourcing it will take a great deal of time and energy, which could be better spent handling more pressing issues (such as fixing bugs in the stable release and adding features to the development release).

Let me reiterate that I DO NOT SPEAK FOR THE CONDOR TEAM.  This is just my understanding of the policy.
